Tranmission problem

Tranmission problem
My car accelerates for a while and then my car starts shaking when I try to force it to accelerate some more. Eventually it starts moving, but the engine still runs. I checked the transmission fluid and it's pretty brown. My cousin came to check the car out and told me I need a new transmission.
My question is, if my transmission was out already wouldn't my car not have moved at all? Should I bother getting a tranmission flush and see if that helps or is it hopeless?

The shutter could be a symptom of a falling torque converter.
If your brother is mechanic, ask him to show you how to change the fluid in the trans pan. This changes about 1/3 of the fluid. Do this between drives a number of times until the fluid looks at least reddish.
Then check for any change in operation.
You could flush the trans but it cost more money. If going the flush route just have them change the fluid, do not use any cleaning chemicals during the flush.
