I hate to say this, but good luck. I have the 3.5 and I have hunted for a good deal on an intake system. I know they typically don't do much but they do sound awesome.
Even the cheap eBay ones are too much money in my opinion. I have done a lot of searching and I always come up empty.
You could try to see if there is a 'wanted' section over at the toyotanation forum. They just have more members and might be able to point you in a better direction.
If you do find something, please post back, I'd love to know...

Thanks for the timely reply. I'm going to a motorsports parts house today who sells intakes to get the lay of the land here. Also reached out via email to Injen directly for their take. They are located in Pomona CA. about 45 mins from me. I'll report back with my findings.

Here is the reply from a large California based Cold Air intake manufacturer and distributor on my request for clarity on the part. I publish this strictly as a service to those here who want to buy one:

"Unfortunately, this intake is not legal for street use in California. It will not pass a California smog inspection and could also result in a citation for an illegal modification if the vehicle is inspected roadside and the hood is opened. Because of this, we are not able to ship this intake to California.

For Toyota, Scion, and Lexus vehicles after the 2005 model year, CARB approval is not possible due to the factory hydrocarbon trap that is built into the stock intake system. The California Air Resources Board considers removal of this component to be an emissions-related modification, even though our intake systems would still meet tailpipe emissions standards during a smog test. Under CARB regulations, this prevents the intake from receiving an EO number.

We are actively exploring potential solutions, but at this time there is no workaround, and the intake cannot be shipped to California or legally used on a street-driven vehicle in California."
